Terms of Reference for Capacity mapping of criminal rehabilitation systems targeting short term prisoners
a. THE ORGANIZATION: KAALO Aid and Development Organization (KAD) is a voluntary humanitarian organization, which was established in Garowe in 1991 from where it has been operating ever since. It is among the few non-profit N.G.Os that sustained up until then. During its life span of 26 years, KAD has implemented more than 100 projects and programs covering Puntland and South central parts of Somalia. Over the years, the organization gained experience as well as strengthened its internal capabilities to program implementation in order to achieve its projected goals. KAD had developed its five strategic plans and conducts regular review of its achievements, mission, principles and values. The organization had undergone external auditing exercises sponsored by various international funding agencies.
b. THE PROJECT: Access to justice and human rights in the pre and post-trial detention system is largely lacking in Puntland State like the rest of the country. Indeed, for most criminal and non-criminal cases, the lack of knowledge on one’s own rights to attorney / legal counsel and the maximum periods of legal detention by security organs. Furthermore, detainees are guaranteed a basic set of human rights, the delivery of this is uncertain in Somalia given government revenue gaps, detainees are usually not considered high priority focus groups for a large number of actors. In addition, human and facility resource constraints are some of the challenges that affect the delivery of justice to victims and perpetrators alike and the effectiveness of justice mechanisms. A lot of work remains to be done focusing on Non-State in Somalia and Puntland in particular on NSAs engaged in monitoring the capacity and delivery of human rights in the justice system mechanisms. In particular, little efforts has gone into facilitating NSA contribution of Legal Counsel for pre and post-detainees thus inadvertently resulting to security agency excesses as evidenced by numerous human rights abuses perpetrated by the security organs. Kaalo Aid and Development together with Puntland State University has secured grants from the European Union to implement a two year project entitled “Enhancing the Role of Non-State Actors in Monitoring Human Rights Delivery within the Criminal Justice System Value Chain in Puntland”.
The overall goal of the project is to enhance effective delivery of human rights by the state of Puntland to the general population and the criminal justice system. KAALO will partner with the Ministry of Justice, National Police Force (Custodian Corps), Office of the Human Rights Defender, Puntland State University, and the Judiciary as well as partner local CSOs / CBOs engaged in human rights initiatives to establish an independent monitoring mechanism that will advocate to improve criminal justice system value chain as well as the detention centers and the rehabilitation mechanism.
PROJECT RESULTS:
Outcomes 1.1: Enhanced NSA capacity to support Puntland government’s delivery of Human Rights in the justice system value chain.
Outcome 1.2: Enhanced NSA dialogue and engagement in human rights advocacy within the justice system value chain. Outcome 1.3: Enhanced quality of detention services within detention services in Puntland’s detention system.
CONSULTANCY DESCRIPTION
Post-trial detention of convicted criminals is a key criminal rehabilitation mechanism that is integrated into the justice system in any country or state with a view to not only isolating criminal elements from the general population but as a sanction for encouraging behavioral change. The case of Puntland is no different in terms of the objectives of the prison system but has a significant difference from other countries. Further, they are often illiterate with no economic skills that they can utilize for post detention livelihoods thus posing a risk of return to crime upon their release. Effective criminal rehabilitation in Puntland is thus in critical need of sustainable prisoner rehabilitation systems with a view to capacity investments with basic numeracy and entrepreneurship.
Iin this Proposal , KAALO seeks to train a targeted 400 prisoners in entrepreneurship skills for successful integration with communities upon their release through the adoption of sustainable livelihoods. Furthermore, through the establishment of vocational / technical and entrepreneurship training at the existing prison facilities, the action will kick start the existence of sustainable prisoner rehabilitation mechanisms through training as well as a prison services and production products that will not only be a source of revenue to the state but also be a source of start-up grants for prisoners upon their release.
The proposed intervention also focuses on enhancing the access to capacity investments for effective port trial rehabilitation during detention for the prison system for sustainable post detention livelihoods and to minimize the incidences of repeat offenders due to lack of livelihood opportunities post detention.
PURPOSE:
The purpose of the consultancy is to assess Capacity mapping of criminal rehabilitation systems targeting short term prisoners in Puntland. The consultant is required to carry out extensive and in-depth appraisal and consultations with the different stakeholders responsible for criminal rehabilitation and re-integration with the society within the justice system value chain.
METHODOLOGY & TASKS
Specifically, the Consultant will:
- Literature review of the proposals, project specific results frameworks, and the Log frame.
- Carry out a situation analysis targeting major Puntland prisons which will include a desk review and best practice; Consultation with relevant stakeholders including: Judiciary, Private Practitioners, Prosecutor General’s Office, Attorney General’s Office (AGO), Puntland Custodian Corps (PCC), Ministry of Justice & Religion and Rehabilitation among other stakeholders.
- Assess the life skills Training required the short-term prisoners in Detention systems based on market needs
- Capacity mapping and assessment of criminal prison’s rehabilitation systems in the areas of; Behavioral and Psychological, Technical Vocational Training, Academic & Religious Education and Sports & Recreational facilities of the prisons in Puntland with special attention to the current rehabilitation mechanisms, challenges, opportunities and the way forward.
- Based on the findings Two Policy Briefs should generated from the report findings
- Develop a mechanism for prison rehabilitation and reintegration based on best practices. The mechanism should demonstrate; The pathway that an offender should accomplish in order to gain parole and opportunity to reintegrate into the community
DELIVERABLES
Working under the direct supervision of the KAALO’s Program Director, the Consultant shall deliver the following outputs:
- An inception report that includes detailed methodology, work plan, and data collection tools;
- Data collection through different methodologies which include focus group discussions and key informant interviews with Puntland criminal rehabilitation stakeholders;
- Draft report submitted to the KAD Project Coordinator that will include a background, approach and methodology used, the detailed findings, recommendations and conclusion, and annexes;
- A comprehensive mapping report with incorporated comments and inputs from the stakeholders, submitted in both electronic version and signed hard copy including recommendation and implementation strategies.
- 2 policy Briefs should produced based on the key findings of the assessment report
- A validation workshop will be organized to finalize the outcomes of the constancy work
REPORTING AND TIMEFRAME OF THE SURVEY
The assignment should be carried out a period of 20 working days . The study Consultant will report to the KAALO Program Director.
QUALIFICATIONS AND EXPERIENCE
- At least a Degree qualification in any of the following areas Law, Human Rights, Governance and Public administration, or any other relevant degree from recognized institutions.
- Must have minimum of 5 years’ of overall experience conducting baseline assessment for criminal justice system, access to justice and rehabilitation
- Demonstrated experience of working in donor funded projects under public sector and /or NGOs.
- Must demonstrate a minimum of 4 years’ experience of conducting assessments in the Greater Horn of Africa particularly in Somalia.
- Must have good understanding and sound knowledge on human rights and justice sector
Skills/Others
- Excellent written and oral communication skills;
- Fluent in English and Somali
- Willingness to travel anywhere in Puntland
